Terms of Service

These Terms of Service constitute an agreement between you and The Kingsmen ICT ("Tkchost", "The Kingsmen ICT", "we", "us" or "our").

By accessing our website, creating an account, purchasing a product, registering a domain, ordering hosting or using any of our services, you agree to comply with these Terms of Service and any applicable policies referenced by them.

If you do not agree with these terms, you should not purchase or use our services.

The Kingsmen ICT provides technology and digital services to individuals, businesses, organizations and other customers.

Specific services may be subject to additional product-specific policies, technical requirements, acceptable-use rules or third-party terms.

You are responsible for maintaining the security and accuracy of information associated with your account.

• You must provide accurate, complete and current information when creating or maintaining an account.
• You are responsible for keeping your login credentials confidential.
• You are responsible for activities carried out through your account and services.
• You must immediately notify us if you believe your account has been compromised.
• You must not allow your account or services to be used for unlawful, fraudulent or abusive activity.
• You are responsible for maintaining appropriate backups of your data unless a specific backup service has been purchased or expressly included in your service.

Prices for our products and services are displayed on our website, client portal or communicated to you before an order is confirmed.

• Services must be paid for according to the applicable billing schedule.
• Recurring services must be renewed before their expiration date to avoid interruption.
• Unpaid invoices may result in suspension, termination or deletion of the associated service.
• Additional charges may apply for services, resources or features outside the original order.
• Customers are responsible for ensuring that payment information and billing details remain accurate.

Refund eligibility depends on the type of service, the time elapsed since purchase, whether the service has been used or provisioned, and the applicable exclusions.

Refund requests must be submitted through the Client Area or another officially designated support channel.

Standard Hosting Refund Period

Services Generally Not Eligible for Refund

• Domain name registration, transfer and renewal fees.
• Dedicated server services.
• VDS services above the applicable refund threshold.
• Administrative or setup fees.
• Software licenses and activated licenses.
• Digital products that have been delivered, downloaded, activated or installed.
• Services that have been materially used, configured or provisioned specifically for the customer.
• Cryptocurrency payments, where applicable, due to the nature of such transactions.

Hosting-Specific Refund Terms

Shared & Reseller Hosting: Eligible first-time purchases may qualify for a refund within 7 days. Biennial and triennial plans are generally not refundable.

VPS Hosting: Eligible first-time VPS purchases may qualify for a refund within 7 days. Yearly, biennial and triennial plans are generally non-refundable.

VDS Hosting: An eligible first VDS purchase below the applicable price threshold may qualify for a refund within 4 days. Yearly plans and accounts with multiple VDS purchases are generally non-refundable.

Dedicated Servers: Dedicated server services are generally non-refundable due to provisioning, setup, infrastructure and related costs.

Our services must be used responsibly and lawfully. You must not use Tkchost infrastructure, websites, servers, domains or services for activities that violate applicable laws or cause harm to other users, networks or systems.

Prohibited Activities

• Fraud, scams, phishing or impersonation.
• Malware, ransomware, viruses or malicious code.
• Unauthorized access to computer systems, networks or accounts.
• Distribution of content that violates applicable Nigerian law or other applicable laws.
• Activities intended to disrupt, overload or interfere with our infrastructure or third-party networks.
• Spam, unsolicited bulk messaging or abusive email activity.
• Hosting or distributing stolen, compromised or unlawfully obtained information.
• Any activity that places our infrastructure, customers or third parties at unreasonable risk.

We may investigate suspected abuse and take reasonable action, including restriction, suspension or termination of services where appropriate.

Domain registrations, transfers and renewals are subject to the rules and policies of the relevant domain registry, registrar and applicable authorities.

• Customers are responsible for providing accurate registrant information.
• Domain renewal payments must be made before the applicable expiration date.
• Domain names are subject to registry and registrar policies.
• Domain registration and renewal fees are generally non-refundable once processed.
• Certain domain extensions may have additional eligibility requirements or restrictions.

Hosting services are provided according to the specifications of the selected hosting package, including available storage, bandwidth, CPU, memory, software and other allocated resources.

Customers are responsible for the websites, applications, files, databases, email accounts and other content stored or operated through their hosting account.

Digital products may include scripts, themes, templates, software, plugins, applications, licenses and other downloadable or electronically delivered products.

• Digital products must be used according to the applicable license.
• You may not unlawfully redistribute, resell, sublicense or reproduce proprietary products.
• Products may require specific hosting, software or server environments.
• Compatibility with every server, browser, operating system or third-party service is not guaranteed unless expressly stated.
• Digital products that have been delivered, downloaded, activated or installed are generally non-refundable.

Unless otherwise stated, content, software, graphics, designs, trademarks, branding, documentation and other materials provided by The Kingsmen ICT remain the property of The Kingsmen ICT or their respective licensors.

You may not reproduce, modify, distribute, publish, sell, sublicense or otherwise exploit proprietary materials without appropriate authorization.

Customer-owned content remains the customer's responsibility and ownership, subject to any separate agreement governing the relevant project or service.

We may suspend access to a service where reasonably necessary to protect our infrastructure, customers, third parties or the integrity of our network.

Suspension may occur because of:

• Unpaid invoices or expired services.
• Suspected abuse or violation of these Terms.
• Illegal or fraudulent activity.
• Security threats or compromised accounts.
• Activities that negatively affect other users or network infrastructure.

Where reasonably practicable, we may notify the customer before or after suspension depending on the circumstances.

Either party may terminate a service in accordance with the applicable service terms and billing arrangements.

We reserve the right to terminate or permanently restrict services where permitted by law if a customer materially violates these Terms, engages in unlawful activity, fails to pay required fees or repeatedly abuses our services.

Termination does not automatically create a right to a refund unless the applicable refund policy expressly provides otherwise.

If you believe that a payment was made incorrectly or that a billing error occurred, please contact us before initiating a chargeback or payment dispute.

We reserve the right to investigate disputed transactions and temporarily restrict affected services while a payment dispute is being reviewed.

Fraudulent or abusive chargebacks may result in account suspension or termination, subject to applicable law.

To the maximum extent permitted by applicable law, The Kingsmen ICT shall not be liable for indirect, incidental, special, consequential or punitive damages arising from the use of, or inability to use, our services.

This may include loss of profits, revenue, business opportunities, data or other economic losses, except where liability cannot lawfully be excluded or limited.

Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

We may update these Terms of Service from time to time to reflect changes to our services, business practices, legal requirements or operational policies.

Updated terms will be published on this page. Unless otherwise stated, changes become effective when published.

Your continued use of our services after updated terms become effective constitutes acceptance of the revised Terms of Service.

These Terms of Service shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria, subject to applicable laws and regulations.

Any dispute arising in connection with these Terms shall be handled in accordance with applicable Nigerian law and the jurisdiction of the appropriate courts.
